New Delhi: On 6th January 2023 Shubham Sharma, the founder of NEO POLITICO an international media group posted a tweet claiming that a six year old Brahmin kid was in jail in a false SC/ST Act case.

The similar claim was also mis-reported by several Twitter users and some media groups including the parent company of NEO POLITICO, the Falana Dikhana here and OpIndia here; it mentioned “A district court in Uttarakhand’s Tehri sent a six-year-old child to jail along with his family booked under SC/ST Act.” NCM India Council for Men Affairs also tweeted the same claim here; you can find the web archive for the same here.
Fact Check/Verification
We started the fact check first by simply using the keywords “Uttarakhand”, “Tehri”, “6 year old” and we came across this report by Amar Ujala. It reported that it was a land dispute case and the Police filed cases under sections 323, 354, 392, 506, SC/ST Act at Munikireti police station, Tehri, Uttarakhand.
The District Session Court Judge Yogesh Kumar Gupta also stated that there were enough evidences against the accused women in the chargesheet. The accused woman then started calling it a “police conspiracy” and pleaded for acquittal and the Court asked her to file a bail application for the same. She did not file the bail application and hence was sent to jail. According to the accused women her child could not stay in the house with anyone else, so she took him along with her when she was sent to jail.
The Falana Dikhana article mentioned these names “Lakshmi Devi, Sita Devi, Atul, Amit and 6 year old Abhinav” stating that the five of them were sent to jail.
We then visited the e-courts website of Tehri, Uttarakhand and searched with the keyword “Atul” under Services-Court Order-Party Name.
We came across these cases:
Here, we found the Court Case dated 06-01-2023. The Court order mentioned Amit Bauthiyal, Atul Bauthiyal, Sita Devi and Lakshmi Devi and NOT 6-year-old Abhinav.
Thus, the claim made on social media and some media outlets that a 6-year-old boy was sent to jail under false SC/ST Act by the District Court of Tehri, Uttarakhand is completely FALSE.
